Terms of Use for Bench Fi

Welcome to Bench Fi. These Terms of Use ("Terms") govern your use of the Bench Fi mobile application ("App"), which is operated by Bench Fi ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, you may not use the App.

1. Eligibility and Account Requirements

The App is intended for individuals 16 years of age or older who reside in the United States. If you are under 18 years of age, you must have permission from a parent or legal guardian to use the App.

By using the App, you represent and warrant that:

  • You meet the minimum age and residency requirements
  • The information you provide is accurate and truthful
  • You will use the App solely for personal, non-commercial purposes

You are responsible for maintaining the confidentiality of your account credentials and are liable for all activity that occurs under your account.

2. Description of the Service

Bench Fi provides users with data-driven insights into their financial and professional status by analyzing information such as resumes, income data, and job preferences. The App uses AI tools to generate personalized benchmarking information.

3. User Content and Data

You may upload documents, text, images, and other materials ("User Content") to the App. By doing so, you grant us a non-exclusive, royalty-free, worldwide license to use, process, analyze, and store that content for purposes of operating and improving the App.

You represent and warrant that:

  • You have the legal right to share the content
  • Your content does not violate any third-party rights or laws
  • You are solely responsible for any content you submit

4. Future Data Sharing and Sales

At present, Bench Fi does not sell or share your data.

In the future, we may share or sell select data in bulk to vetted headhunters or recruiting partners. This may include identifiable data and would be based on specific internal selection criteria.

You acknowledge and agree that your data may be used in this way if this feature is introduced.

5. Prohibited Conduct

You agree not to:

  • Use the App for illegal or unauthorized purposes
  • Upload false or misleading information
  • Interfere with the security or functionality of the App
  • Access accounts or data of other users
  • Distribute viruses or malicious code

We reserve the right to suspend or terminate your account if you violate these Terms.

6. Account Deletion and Termination

You may delete your account at any time through your profile settings in the App. Upon deletion:

  • All of your data will be permanently removed from our systems
  • This process is irreversible
  • We do not retain deleted user data

We also reserve the right to suspend or terminate accounts at our discretion.

7. Intellectual Property

The App and its content, design, and features are the exclusive property of Bench Fi and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, or modify any part of the App without our prior written consent.

8. Disclaimers

The App and all services are provided on an "as is" and "as available" basis. We do not guarantee that:

  • The App will be error-free or continuously available
  • The information provided will be accurate or reliable
  • You will achieve any specific results by using the App

To the fullest extent permitted by law, we disclaim all warranties, express or implied.

9. Limitation of Liability

To the maximum extent permitted by law, Bench Fi shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. This includes, but is not limited to, loss of data, opportunities, or income.

10. Modifications to the Terms

We may update these Terms at any time. If we make material changes, we will notify you through the App or your registered email.

Continued use of the App after changes constitutes your acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles. Any legal disputes shall be resolved in courts located in Cook County, Illinois.
